Question on Notice – 4 July 2012
“Does the Tribunal advise Complainants that since the passage of the Superannuation Industry (Supervision) Legislation Amendment Act 1995 No.144, 1995 that the Tribunal no longer has the statutory power to deal with complaints alleging that the Trustee (or an agent of the Trustee) has made a decision that:
(a) was in excess of the powers of the trustee; or
(b) was an improper exercise of the powers of the trustee,
and that the Tribunal Chairperson MUST give particulars of a suspected or alleged contravention of the Governing Rules of the Fund to APRA and/or ASIC by way of Referral under Section 64 Notices”?

“Can the Tribunal Chairperson confirm that the most common complaint received by the Tribunal is an allegation that a defined benefit has not been determined strictly in accordance with the Governing Rules of the Fund and that this type of complaint accounts for 17 percent of the complaints received by the Tribunal”?

“Can the Tribunal Chairperson provide an explanation to the 12 Million unique Members of Government Regulated Superannuation Funds as to why if the Tribunal receives so many Complaints each year alleging fraudulent conduct by the Fund Trustee that you as the Chairperson of the Tribunal only provide on average of Three Referral Under Section 64 Notices to the Prudential Regulator APRA each year?
