Smithson v Hamilton

Smithson and others v Hamilton [2007] EWHC 2900 (Ch); [2008] 1 WLR 1453

In this case the Trustee and employer claimed that a mistake had been made in the drafting of the Rules of the Fund which provided for unanticipated better benefits that resulted in higher costs for the Participating Employers.

The court rejected the claim to correct the mistake.
